  • Illustrations, marketed in print form. Limited series and signed on the front.
  • Illustrations marketed in their original format. Unique signed copies. It is specified in the product description if they are original.
  • Personalized portraits, from photos or images provided by the client. In physical and digital format. For personal use only unless expressly agreed otherwise by both parties.
  • Personalized illustrations from photos or images provided by the client, in physical and digital format. For personal use only unless expressly agreed otherwise by both parties.
  • Merchandising products with their own illustrations such as mugs, notebooks, cloth bags or tote bags, etc. In addition to those offered on the web, the client may request a quote to make these products with the personalized illustrations that have been created for him.
  • Customization of garments provided by the client with personalized illustrations created exclusively for him from photos or images provided by the client himself.
  • We also carry out other projects outside of what is stated on this website, in which case a specific scope of work and budget will be agreed for that project.

Who are the parties involved?

The intervening parties are constituted by the User or Client and the Responsible, identified in the first section, of this web page, www.arranzastasio.com

 Any user who buys the items offered at www.arranzastasio.com will be considered a Client may it be individual, of legal age, with legal capacity and who provides the necessary data for the contract. Likewise, any legal entity that accrediting this condition accepts the terms set forth herein. In both cases, the Client must have sufficient legal capacity to contract the services offered by this website.

What is the purpose of these general contracting conditions?

The general contracting conditions exposed here together with the particular conditions that may be determined, will regulate the relations between the users of the web page, hereinafter User or Client, aimed at the purchase of any of the items included in "virtual stores" or «the spaces» of each one with the products or services they offer.

These conditions will be in force from their publication on the website indefinitely. Any modification will be published on our website, and the Client must accept them at the time of contracting the services offered here, whatever their modality. Likewise, the purchase of any item offered on our website implies acceptance of these general contracting conditions by the User, as well as the particular conditions that may be applicable to contracting.

Arranz Astasio reserves the right to make the modifications it deems appropriate on the platform without prior notice, being able to change, delete or add both the content and the services provided through Arranz Astasio.

What responsibilities does Arranz Astasio have?

Arranz Astasio will only assume the responsibility that legally corresponds to it regarding the accuracy of the information provided by BUYERS, which means that it may be exempt from responsibility for the consequences produced by the events caused by said data.

Arranz Astasio will be liable for the damages that the BUYER may suffer as a result of the use of Arranz Astasio when said damages are caused by an act of intent - fault on the part of Arranz Astasio The BUYER, after accepting these Conditions is aware that the use of Arranz Astasio is at your own risk.

The BUYER accepts that technically it is not possible to achieve 100% Arranz Astasio availability. However, Arranz Astasio will provide all necessary means to keep the platform available for as long as possible. Arranz Astasio is not responsible for the inconvenience caused by interruptions in its services that are not due to an intentional action.

Arranz Astasio is not responsible for the websites of third parties that can be accessed through links ("links") or for any information offered by third parties. The connection with a third-party website will be by decision of the BUYER.

What content will not be accepted in Arranz Astasio?

You may not upload to Arranz Astasio any content that is: Abusive, threatening, defamatory or harassing, or otherwise violates our Non-Discrimination Policy, obscene or vulgar; that violates the privacy or intellectual property rights of another person; either false or misleading.

What are the buyer's obligations?

The BUYER agrees to:

  • Use Arranz Astasio according to the Conditions of Use.
  • Provide accurate data and always keep it updated.
  • Do not present information contrary to the Conditions of Use of Arranz Astasio, nor to current legislation.
  • Do not use false personal data, nor supplant the identity of third parties in the use of Arranz Astasio or the use of its products or services.

 

What is the purchasing system?

The purchase process is structured in different phases depending on the type of product or service chosen, as indicated below. The purchase process may vary slightly to adapt to the needs of each Client or type of product or service offered, and to facilitate the purchase.

On line store

Step 6.- Once the process is finished, you will receive a confirmation of your order. The BUYER will receive in less than 24 hours the confirmation of their order to the indicated email.

Step 7.- Receive your order.

Custom illustrations

Step 1.- Selection of the desired item.

Step 8.- I will make a first sketch that I will send you by mail so that you can give me the go-ahead. In this step you will be able to iron out some aspects, but not redefine the concept of the illustration.

Step 9.- Receive your order.

Customized Garments

Step 1.- Selection of the desired item.

Step 6.- Once the process is finished, you will receive a confirmation of your order. The BUYER will receive in less than 24 hours the confirmation of their order to the indicated email.

Step 7.- I will contact you by e-mail to provide you with a form with the necessary data to carry out the order, as well as the specifications of the image files that I will need. You will tell me if the garment is one that you already have and you are going to deliver it to me or you are going to acquire one specifically for this.

Step 8a.- If it is one that you already have, I will give you a postal address so that you can send it to me. The cost of shipping the garment to my workshop will be borne by THE CUSTOMER.
Step 8b.- If you are going to buy a garment specifically for this in an online store, I will give you a postal address so that you can send it directly to my workshop. You will provide me with the order number so that I can check what your garment is before starting. I will confirm receipt and check with you that it is the correct garment.

Step 9.- I will make a first sketch that I will send you by mail so that you can give me the go-ahead. In this step you will be able to iron out some aspects, but not redefine the concept of the illustration.

Step 10.- Receive your order.

Other projects

Step 1.- Fill in the contact form describing what type of order you want to carry out.

Step 2.- Delivery of a fee by the illustrator

Step 3.- In case of acceptance by the client, payment of 50% is made in advance, unless otherwise specified.

Step 4.- Once the order is finished, the client is notified to make the payment of the remaining 50%, or the remaining % agreed.

Step 5.- Delivery of the item to the address provided.

Normally, in the case of the purchase of items, the standard delivery is within 24 business hours, but these are estimated times and the agencies usually make deliveries until approximately 7:00 p.m., many of our products are handmade, so many of they are manufactured for you, contact me to know the time of preparation and processing of the order since each one of them may have specific specifications for shipments.
One step before confirming your order, you will be presented with a screen with the complete details of your purchase. You will see the items in your order, their price and availability at the time of purchase, the shipping costs, the payment method and the management costs, if any. I will send you an e-mail with all the details of the order.
We ship orders, always, after confirmation of payment. Once the order leaves the seller's store, we will issue the invoice, send it to you by email and you can download it from your Order List.
The prices indicated in the store include VAT and are in Euros.
The established payment method is by bank card through Paypal or Stripe, which use security encryption, also complying with PSD2 protocols in order to avoid fraud and identity theft. For added security, data transmission is encrypted using an SSL certificate.
When required, payments will be collected by transfer or by another bank payment service, with full observance and compliance with current privacy and data protection regulations.
If you want an invoice, you can request it from Arranz Astasio so that the BUYER can download it.

How does the shipping system and delivery times work?

Delivery period

Products not dependent on a custom design will be shipped within 48-72 hours after payment is completed. Products dependent on a personalized design will have an estimated delivery of 2 weeks, which will be limited with the client once the order has been formalized.

Shipping costs

Shipping costs are borne by the customer for orders of less than 40 euros for orders in Spain and less than 100 euros for orders from the rest of Europe; and on behalf of Arranz Astasio in orders over that amount.

  1. The purchased products will be delivered to the person and to the address indicated in the order. Shipments will be made in addition to the Peninsula to the Balearic Islands, Ceuta, Melilla and the Canary Islands, as well as Europe.
  2. On Saturdays, Sundays and holidays there will be no exit or delivery of orders.
  3. However, its delay will not imply either cancellation of the order or any compensation.
  4. An order is considered delivered at the time the carrier delivers the package or packages to the BUYER and the BUYER signs the delivery receipt document.
  5. It is up to the BUYER to verify the condition of the merchandise upon receipt and indicate all anomalies on the delivery receipt.

How is the refund system?

  • If the product is defective or has been damaged during transport:

In the event that the product is defective, the BUYER can return it with all its accessories, Arranz Astasio assuming the shipping costs generated by the delivery of the product and its return. Arranz Astasio will proceed to resend the repaired or replaced product, completely free of charge. If the product has been damaged during transport, the BUYER must notify us within a maximum period of 24 hours from receipt of the product and note the incident on the carrier's delivery note. When receiving the order, before opening the package, the BUYER must verify that the packaging is in good condition. If the BUYER notices any anomaly before opening the product, please do not open the seal or the packaging of the same. Arranz Astasio will make its transport company available to the BUYER for the removal of the merchandise, free of charge. If the BUYER wishes to return the merchandise with a transport company other than the one proposed by Arranz Astasio, and the transport company selected by the buyer offers higher rates, the buyer will assume the difference in transport cost.

 If the product does not arrive at its destination:

Arranz Astasio will proceed to the full refund of the money to the BUYER. To do this, the BUYER must contact Arranz Astasio via email hola@arranzastasio.com or through the contact form that Arranz Astasio has established in his file, to process the return of the order.

In the event that the BUYER has returned a product based on an alleged defect or error in the merchandise, and it is finally determined that there is no such defect or error, the return costs will be borne by the BUYER.

How to apply the right to cancel the purchase exercised?

The BUYER may also exercise their right of withdrawal within a maximum period of fourteen (14) calendar days from receipt. The refund of the amount of the purchase will be made once the condition of the merchandise has been verified and will be made through the same means of payment used for the payment of the order and, in any case, within a maximum of 14 calendar days from the reliable receipt of the withdrawal request, as long as it is Arranz Astasio who manages the collection of the item. In the event that the buyer returns the item through a transport company of his choice, the period of 14 days will begin to compute from the time that Arranz Astasio has effective knowledge of the shipment of the merchandise or, failing that, from the receipt of the Article.
The BUYER shall assume the decrease in value of the goods resulting from a manipulation of the same other than that necessary to establish its nature, its characteristics or its operation. In this sense, Arranz Astasio will analyze the state of the product with respect to which the right of withdrawal has been exercised, and in the corresponding cases, it will reliably communicate to the Buyer the existence and amount of this depreciation in the price of the product, justifying in any case on objective and verifiable criteria.

The right of withdrawal will not be applicable to contracts that refer to:
a. The provision of services, once the service has been fully executed, when the execution has begun, with the prior express consent of the consumer and user and with the acknowledgment on their part that they are aware that, once the contract has been fully executed by the entrepreneur, you will have lost your right of withdrawal.
b. The supply of goods or the provision of services whose price depends on fluctuations in the financial market that the entrepreneur cannot control and that may occur during the withdrawal period.
c. The supply of goods made according to the specifications of the consumer and user or clearly personalized.
d. The supply of goods that can deteriorate or expire quickly.
e. The supply of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and that have been unsealed after delivery.
f. The supply of goods that after delivery and taking into account their nature have been mixed inseparably with other goods.
The return costs derived from the exercise of the right of withdrawal, will be borne by the BUYER.

What is the warranty policy?

The products that we offer at Arranz Astasio are guaranteed at a national level, against manufacturing defects for two years from the date of delivery. The warranty does not include damage caused by misuse or normal wear.
Repair and replacement will be free for the consumer and user. Said gratuity will include the necessary expenses incurred to correct the lack of conformity of the products with the contract, especially the shipping costs, as well as the costs related to labor and materials.
Unless proven otherwise, it will be understood that the products are in accordance with the purchase provided that they meet all the requirements that are expressed below:
a) They conform to the description made by the Arranz Astasio and possess the qualities of the product that the Arranz Astasio has provided in the form of a sample or model.
b) They are suitable for the uses to which products of the same type are ordinarily destined.
c) Present the usual quality and features of a product of the same type that the consumer and user can reasonably expect, taking into account the nature of the product.

On the protection of personal data

In accordance with the General Data Protection Regulation and the Organic Law on Data Protection and guarantee of digital rights, we inform you that the personal data provided by the BUYER for the acquisition of products or services will be used to manage the order placed. The legal basis for data processing for this purpose is the execution of these conditions.
Likewise, your data may be used to send you information about our products and services by electronic means. The legal basis for the processing of your data for this purpose is the legitimate interest of Arranz Astasio in retaining its users and keeping them informed about our services that may be of interest to them. You can oppose the receipt of said information through the simple and free procedure that we make available to you in each commercial communication or by sending an email to hola@arranzastasio.com
You have the right to obtain confirmation on whether or not Arranz Astasio is processing personal data that concerns us.
Interested persons have the right to:
• Request access to personal data relating to the interested party
• Request its rectification or deletion
• Request the limitation of your treatment
• Oppose the treatment
• Request data portability
Interested parties may access their personal data, as well as request the rectification of inaccurate data or, where appropriate, request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected. In certain circumstances, the interested parties may request the limitation of the processing of their data, in which case we will only keep them for the exercise or defense of claims.

Arranz Astasio will stop processing the data, except for compelling legitimate reasons, or the exercise or defense of possible claims. As an interested party, you have the right to receive the personal data that concerns you, that you have provided us and in a structured format, of common use and mechanical reading, and to transmit them to another data controller when:
• Treatment is based on consent
• The data has been provided by the person concerned.
• The treatment is carried out by automated means.

By exercising your right to data portability, you will have the right to have personal data transmitted directly from controller to controller when technically possible.
Interested parties will also have the right to effective judicial protection and to file a claim with the control authority, in this case, the Spanish Agency for Data Protection, if they consider that the processing of personal data that concerns them violates data protection regulations.

Arranz Astasio is responsible for complying with its own personal data protection obligations.

And what about intellectual property?

The total or partial reproduction of the contents of Arranz Astasio is prohibited without express written consent. The non-consensual exploitation of these contents will give rise to the legally established responsibilities.

The BUYER will make appropriate use of the contents and services that Arranz Astasio offers, fundamentally of the photographs made available to which it claims to have rights for their use. Arranz Astasio will not be responsible for infractions carried out by BUYERS on the platform that affect third parties.

The BUYER agrees to be solely responsible, Arranz Astasio being exempt from liability in the event of copyright infringement claims.

What language governs these conditions?

These contract conditions will be available in the Spanish language, which will prevail over the translations made of them into other languages.

What is the applicable legislation and to which courts should one go?

These general contracting conditions are made in compliance with the following regulations in force regarding contracting and electronic commerce:
〉 Law 34/2002, of July 11, on services of the information society and electronic commerce.
〉Royal Legislative Decree 3/2014, of November 16, which modifies the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.
〉Law 7/1998 on General Contracting Conditions.
The Spanish legislation in force at the time of contracting will apply to these contracting conditions. Any dispute arising from the contracting of the services and products offered on our website will be submitted to the jurisdiction of the courts of Madrid.
